NO will, No poa, no exectetor

My Father died I am one of five children. He left no will and no P O A and No wife. We need to get in his safety deposit box and clean out his checking acoount. What do we need to give one sibling the right to handle all the bills and checking account.

One of the children can petition the Court to be the administrator of the estate of your dad. This will give that individual the power to do what you desire. In addition, if the estate is small enough, other less expensive mechanisms might be available.

One of the children will have to petition the probate court in your county for an administration of an estate without a will. Depending upon the assets in the estate, this can sometimes be through a "small estate" admininstration. Call me if you wish to discuss this matter. 1-877-320-5232
