Witholding Visitation

Mother has legal papers stating that 16 month old child is to reside with her. Could mother be penalized for witholding visitation from father since father is behind on child support?

Yes she can.

Texas law says you cannot withhold visitation for lack of child support payments, and vice versa.

You can file a contempt action to force the visitation.

Expect her to also file a contempt action against you for child support.
