If a woman is not faithful to her husband but is otherwise a very good mother by all accounts, does the infidelity typically impact her custody rights as determined by the court? How does infidelity impact child custody cases?

Wow! That is a great question. It's impossible to answer. Has she been leaving the kids & been out partying? Has been out drinking? Has she been on the computer? Was it a one time event or ongoing? As you can see, it's impossible to answer.

You need to consult with an experienced family law attorney in your county. A divorce is based on many facts and never just one thing.

Technically, infidelity should only impact property division in the State of Texas. If that has totally confused you, just go talk to an attorney. He/she will explain it all to you.

Good luck!
