Legal Question in Family Law in Texas

A women agrees to marry a man under pre-determined conditions. The man gives this women an $8000.00 ring, a $30,000.00 2008 Shelby mustang and her son a $3500.00 older pick up for his birthday. The agreement was that she would marry him and help him run his business because he is 77 years old and does not hear well. He also agreed to build a home on her 20 acres. She would not have pre-marital sex with this man until they were married. The agreement was she would not marry him until he built the home in which both of them where to live in. He has since dumped her and has been seeing another women. He is threatening to sue her for the ring, the car and the truck. She is a teacher in south Texas and makes around $35,000.00 per year and does not have the money to fight him in court. On what grounds and what Texas statute does this man have a right to sue her? and does he have a chance to win?

There is case law which holds that an engagement ring is a "conditional gift." In other words, he would not have given her the ring except that he planned to marry her. When the engagement is off (each will claim it was the other one's fault), she should give back the ring.
