Help! Being wronged over child custody

My husband and I got Permanate Mananging Conservators of a minor child and permission to consent to our own adoption as we were moving out of state. We left the child with someone with a temporary power of attorney to end on 6-17-06 while we moved. On 6-14-06 we notified them we were on our way across country to get our child. On 6-17-06 they filed a restraining order against us and filed a motion to adopt her. We have been fighting this in court. Last court date we were both to have a homestudy they did not show up nor their attorney. We filed motion for default and a hearing is set for dismissal in Jan.07. My question is if we get the dismissal which the judge said will make things go back to the way it was before with us having PMC. Is the decission in effect immediately and can we go and get our child after court?

Your question is very confusing. You have a court order granting you permanent managing sole custody of a child, that you placed with a third person? And that person got a TRO to keep you from getting the child back? Where is your lawyer? A hearing was scheduled, and no one showed up? And it is months later and nothing has been done? If the dismissal is a DWOP from the court, it can be set aside during the next 30 days. Please get a lawyer to straighten out this situation. A child is involved.
