My x lives in tx I live in tx my daughter is 17 she got in trouble for verbally abusing her mother my daughter wants to come live with me my x insist she stay their but she is the reson she got in trouble and if she does it again she will get lock up I haven't seen her in 12 years I pay my child support can she legally come stay without a court order

No. She either needs her mother's consent (get it in writing) or a court order.
If you file a lawsuit for a change in conservatorship, you can ask the judge to talk to your daughter in the judge's chambers (office). Based on her age and assuming there are no ugly facts on your side of the story, a judge is likely to respect the preference of a 17-year old. Not guaranteed to, but likely to.
