Legal Question in Family Law in Texas

getting xgirlfriend out of house

I have broken up with my girlfriend and she refuses to leave my house. The house is in my name only, it is paid off and is soley mine, and she has lived there for 3 years. I have offered money for moving expenses and rent, but she refuses and refuses to leave. How do I get her to leave.

Re: getting xgirlfriend out of house

You need to have her evicted. Generally, this would involved giving her a letter known as a "notice to vacate", which gives her three days to leave.

If three days pass, and she doesn't leave, you may then file suit in the small claims court nearest your home. She will then be served with the petition and will have to show up to court. If you are able to prove your case and/or she does not appear, you will win a judgment from the court requiring her to leave.

If she still does not leave, you can obtain a "writ of possession" from the court that orders a constable to go to the home and remove her from the home.

If you don't feel comfortable handling this by yourself, feel free to contact my office to discuss my fee for evictions.
