Legal Question in Medical Leave in Texas

Laid Off During FMLA Leave

I was on approved FMLA leave after giving birth and was laid off one week before I was set to return to work. The reason given for my being laid off was that the company lost a great deal of business and that there was no work for me. There were others laid off at the same time, but I was the only one laid off in my department. Incidentally, the individual who took over my duties while I was on leave is still employed with the company. Is this a violation of FMLA or just an unfortunate situation?

Re: Laid Off During FMLA Leave

It appears that you may have a strong case for an FMLA violation. I would explore your options with an attorney experienced in employment law matters.
