Legal Question in Medical Leave in Texas

After returning from FMLA after the birth of my child I was told my position was eliminated. I thought my job was safe while on FMLA. Can they do this?

They aren't supposed to. You should have your position or a comparable position waiting for your return. However, they may have been planning on eliminating the position because of the economic downturn. However, they cannot do what they did, the timing is just not appropriate. It looks fishy if nothing else.
