Legal Question in Civil Litigation in Texas

More than 60 days ago, I tried to have a defendant served via certified mail with a return request by the courts. But he has not responded � he is ignoring it � and the trial date is pending for 2-3 weeks from now. Can I get a default judgment? Or if a sheriff or private process server shows up and hands him papers (even if he tears them up), then has he been served?

I'm filing suit in a Harris county justice of the peace court.
