Legal Question in Civil Litigation in Texas

abandon horses

my friend left 3 horses with me. she then vanished. I fed, watered and had the animals treated by a

vet. she reappeared nearly a year later wanting the horses. I told her, she had to pay for their boarding and vet bills. can I hold the horses for the boarding bill, ect. or shall I let her get them? can they be mine by her abandonment?

Re: abandon horses

You have a stableman's lien on the horses for stabling, feeding, vet bills, etc. If she doesn't pay upon written demand you can sell the horses at auction. Proceeds pay the auction fee and your bill. The balance, if any, goes to the previous owner.

The lien is a possessory lien, which means you cannot give them up and still have a lien. If she gives you a personal check you should cash the check at her bank before giving up the horses.
