Legal Question in Civil Litigation in Texas
New Air Conditioning Unit Not Working
Summer of 2006 I purchased a new A/C system (coils and condensor) for my home. Temps outside running 100 degrees or more each day. New unit freezes up on first night. Call Company out numerous times (more than 10) to make adjustments/repairs, but they are unable to get the new system running without freezing up. I ask for a refund so I can get another company out to install a system, but they refuse to refund. Questions; Is this the type of case that would go to small claims or should it be persued in another court? What classification does something like this fall under? Would it be consumer? Is it reasonable to ask for a full refund since this company cannot make their own eqipment work?

The dollar amount will determine whether you can go to small cliams or district court. An attorney may decide you have a claim that should go to district court under the deceptive trade practices act. See a local attorney and go over the contract(s).
