since this is a class c misdemenor can one use the differed adjudication defense if there is no other offense on a persons record

Deferred adjudication probation is a form of punishment and not a defense. The decision whether to offer deferred adjudication probation rests with the state of Texas. You may qualify for such a plea offer if you have never been arrested before, but it does not mean it will be offered in your case.
