Legal Question in Civil Litigation in Texas

Apartment Slander

I lived in a complex that seemed fine when we moved in. However, we requested that someone clean our carpets repeatedly and they did not. I worked for a carpet cleaning and restoration company that could have cleaned them, but the management staff refused my request.

When we moved out, I took pictures (which I have found some, but not all of.) and knew that the carpets would be an issue so I had the Assistant Manager sign a statement that we did request to have carpets cleaned by complex, but this was never done.

Well, we tried to rent with another complex and were told that we could not be leased to because we damaged a previous apartment and had unauthorized pets. Well, I contacted them (both for my security dep. and for a copy of our moveout statement) and they listed damage and cleaning charges. The only ''damage'' was carpet degreasing for $79. There was no mention of Unauthorized pets- in fact the section on the lease for that, states: No Unauthorized pets.

What can we do to clear our name and get our deposit back? Can we take this notice to the new complex as proof that the old complex is lying?

You have grounds for a suit against them. You should hire an attorney.
