Automobile Repair

Are repair companies liable for damages resulting from mis-diagnosing the problem? If you take your car into the shop because the car did not sound right and they make repairs that they felt were required to fix the problem, but actually are not, are they liable for damage which occurred to the vehicle due to not correcting the problem initially.

If the vehicle was damaged by negligent repairs, the company would be liable. The problem is the expense involved. Who is expert enough to testify that the repairs were negligent and damage resulted. If you have someone who will help you with that question, you would have a chance.

Depends on if the problem reasonably SHOULD have been found first& if you can afford to prove it. If damages are confined to additional repairs you might try small claims court if your new mechanic will testify on your behalf. If more major damages you might consider a DTPA claim.
