Legal Question in Civil Litigation in Texas

Bad check

I was given a bad check (account had been closed prior to issue), what recourse do I have to collect and how much time do I have to do so. Is there statute of limitations for such?

Re: Bad check

It depends upon the circumstances under which the check was given. If given at the samed time the giver received either goods or services, that's a criminal matter called theft by check, and should be brought to the Hot Check Div. of your nearest JP court. If given for the extension of credit (you sent a bill, they sent the check) that's purely as civil matter and you can sue them in Small Claims if the check is less than $5,000.00. There's a four-year statute of limitations on debt.
