Legal Question in Civil Litigation in Texas

Borrowed Money

My wife let a ''good friend'' borrow $1000 with the intent that the money was to be paid back in two weeks when her friend received a settlement check in the mail. Well it has been almost 3 months and nothing. Her friend has claimed that she has not received anything yet and has no money to send us. We believe that she has received the settlement and it has already been spent. She claimed she would send some payments every pay day until this could be settled but has sent nothing. Of course we had no contract, but have several emails discussing everything that has gone on. What are my legal corses of action? Is small claims something that I would have to pursue? If I win my case, how do you collect on a small claims judgement? Thanks.

If they won't pay, then Small Claims is your only viable route. Collecting against an individual who has to borrow money to get by is extremely difficult in Texas.
