Legal Question in Civil Litigation in Texas

brother wont pay his loan

My husband bought an atv for my brother and he was to pay us back monthly

over 50 months. All but three payments have been late and currently two

months late. A recent family fued leads me to believe he isnt going to pay at

all anymore, after 2 years of paying he suddenly decided the measly interest

amount we would have gotten was too much. Can we reposses and sell for

the remainder or do we have to get a worthless judgement? Can we send him

a demand for payment and a time limit? What should we do next? Thank you.

What documents do you have to prove up the loan, or hold a security interest?

If you are going to play banker, then do what the banks do.

If my assumptions are correct, all you can do is bring a lawsuit for the unpaid balance and hope you have enough to prove up your case.
