Business owner won't pay for items sold per our verbal agreement

We had a verbal agreement with the owner of a vintage auto restoration shop that he would sell the parts and in turn pay us the money. Then he said he would pay $7500 for the truck. He said later that he couldn't get $7500 worth of parts, but would pay us because he said he would. Still no money since March 2004. He will not return our calls. Sent a demand letter certified mail. That was returned to us but when we talked to the owner he said he received our letter, but he had no money. He told us he sold the motor and transmission and rear end, but we still have not been paid. When we go to the shop, he says he has no money and can't pay us. We have the title. Can we sue him for theft?

We thought about small claims court at $5000, but it seems that it is almost impossible to receive any money. We've been told that the constable can close his shop and remove $5000 worth of his property. We are confused as to what to do and don't know how to contact an attorney. The amount is not large enough for a lot of money to be had. What to do? Please help.

There are a number of problems there, and it's really not something you want to handle pro se. Speak to a collection attorney that practices in your area about suing the owner of the business for the $7500 he owes you.
