Legal Question in Civil Litigation in Texas

car pymts made in one name, title/registration in another

Had a verbal car agreement with a friend. They acquired the car loan in their name because my credit wasn't good 4 yrs ago but all the pymts are in my name and made on time up until March 03. We have since fallen out(issues not related to the car at all) & they came in the middle of the night & took the car from my residence. When I spoke with this person only once since this happened they stated I could only get it back if I got the car out of their name. I asked them to get me the payoff info but I haven't heard anything from this person since. The car will be paid off early next year. I want the car back. When I spoke with the credit union where I have submitted the pymts for the last 4 years the account is setup to not accept anymore pymts from me and pymts are now directly coming from this persons payroll acct. A week before they took the car in March 03 I had just pd to have almost a $1000 dollars of general maintenace done to the car. Can they get away with this? What legal recourse do I have?

Your legal recourse is to sue them for either the money you paid, or title and note to the car. If you don't sue, then they will get away with it.
