Legal Question in Civil Litigation in Texas

Civil suits - What can be subpoena for a case ?

I'm about to file a civil suit in a matter that the

second party refuses to pay second half of a payment.

My question is can I subpoena a check that was written by the second party from that party or from their bank?

If I'm able to get copy of the check, I would be able to prove my case, due to the "notation" on the check indicating 1st of two payments.

So what can an average citizen subpoena agaisnt a second party in a civil case and how do they go about it ?

Re: Civil suits - What can be subpoena for a case ?

The Clerk of Court where your case is pending will issue a subpoena for you. You then have it served on the person or institution to require the document you seek to be produced.

Not understanding this basic procedure may be a precurser to greater technical difficulities down the line.
