What legal options are avialable in a situation when two freinds open an account together for a project and one party spends all the money with out the others consent.Is it considered theft?

Absent some agreement that can be proven, one friend has equal access to the money as to the other. Next time choose friend more carefully and require your signature to cash a check.

It's not theft, it's an error in judgment.
If the project was a business project, where both could be considered as partners in a joint venture, there may be recourse for half of the money.
