Legal Question in Civil Litigation in Texas

collecting on a wrongful death judgement

i was awarded a $200,000 judgement in 1980 when a drunk driver killed my husband. I have never collected any money from the defendant. I would like to know how to go about finding this man and begin collections.

Much will depend on other factors. Is it a Texas Judgment? If so was it abstracted? If so was it renewed? Generally a judgment lien on property is only good for 10 years but it can be renewed. Collection may be difficult if the debtor has no exempt property.

Re: collecting on a wrongful death judgement

First, you need to find the individual. Today, that is not as difficult as it once used to be because of the resources available on the internet. Once he is found, the next step is to find out his assets. This can be done a number of ways, including sending him post judgment discovery or hiring a firm to do an asset check. Finally, there is collection. This depends on what assets you are able to find and where he earns his money. In addition, you may be able to suspend his drivers license, if he is in Texas, and he did not carry insurance at the time of the accident. Please call me if you like to discuss this matter further. Good luck.
