Legal Question in Civil Litigation in Texas
I own a condo in a three story complex. The unit above me had a problem with their AC drip pan causing it to overflow and damage my ceiling and walls. When I submitted my invoice for repair, he stated that his insurance company said he was not liable. Does not seem correct, am I off base?

Sounds more like the insurance company is doing what insurance companies do best - deny claims. Your action lies against the other condo-owner. Sue him and if his insurance company doesn't come to his rescue, then that's HIS problem! He gets to pay the judgment out of his own pocket. That is, if he has any money to pay. If not, then you could be stuck.
