Legal Question in Civil Litigation in Texas

Crazed Mother

My mom came to my boyfriend's house at 2 in the morning to yell at me for late curfew. she then proceeded to call names and get into a heated argument with my boyfriend. She reared back with a clenched fist as if to hit him. He pulled a knife out in self defense with no intentions of hurting her. She flipped, called the cops and claimed that he was going to stab her. If she was the one coming over at 2 in the morning causing a public disturbance, shouldn't she have gone to jail instead?? She was verbally agressive and threatning. What would be the ruling in that kind of case?? No evidence, but 2 witnesses including myself to testify against her?

Without knowing the facts other than your version of events, the threat of deadly force backed up by a weapon capable of injury up to death is likely to result in a criminal assault charge against your "boyfriend." Your mother is unlikely to be charged, and there would therefore be no need to testify against her. Your "boyfriend," however, may be facing significant jail time.
