Legal Question in Civil Litigation in Texas
Credit Reporting and Criminal Background Checks
Two days ago I applied for a lease at a apartment complex in Texas. The complex ran a credit check and criminal background check. The credit reporting agency they used said I was a convicted Felon, so the complex denied my application causing me embarrasment, distress and losing my application fee. The truth is I am not a Felon...I was convicted of a misdemeanor..but the information the credit agency released was false. Do I have a lawsuite against the credit/background screening agency for reporting false information about me when they have a responsibility to tell the truth.

Re: Credit Reporting and Criminal Background Checks
Short answer, yes. But there are some steps you need to take first. First, because the landlord denied you credit, they should give a letter telling you where they got the information they used to deny you. Then you write that agency and dispute the findings and asking them to verify their information. If they don't then you have grounds to file suit.
