Damge to Personal property by City Drainage water

My property, namely my drive way and surrounding areas of it are being damage by the city drainage ditch in front of my home. I live in the City of Marshall, TX. We had a extensive drainage problem in this area of Marshall and I even spoke before the City Council about it. In turn the City repaired the drainage behind my neighbors residence. In front of my home a mound of dirt was placed to attempt to deflect the drainage. My drive way is cracking because the drainage water is washing out the foundation. The mound is also beginning to wash away. I have a large pond of water in my drive way and in my garage on heavy rain days. I am told by lawyers in the city I cannot sue the city. Me and my family are the only black family in this are. Others have had their driveways rebuilt, massive drainage pipes put in to divert the water. But I am told nothing can be done.

Let me just suggest a couple of things. First, see if you can find out who those others are that have had their driveways repaired and talk to them to learn about their experiences. It might give you some ideas about how to proceed. And, if the city is damaging private property, namely, your driveway, then of course they have to pay for it. You have as much right to payment as anyone else and don't let anyone tell you differenlty. Hope this helps a little.
