Legal Question in Civil Litigation in Texas
Deceptive Trade Practices Act and education
I am a student which was denied a grade of "B" by a (.0038%). The grade was based primarily on participation. The professor didn't disclose that his system of grading was different than what was stated in his syllabus. At my hearing, the professor submitted a form which was based on a tic mark grading scale, which was totally different from what was stated in his syllabus. I am also covered under the ADA and was denied certain rights, i.e. having to negotiate with the professor about the allotted time for taking test. I have a statement from another student, that I was not allowed to participate in class discussions. I have followed all channels of normal appeal procedures to no avail. There are other questions which need to be asked but space does not allow for inclusion. This is very complicated because there are other issues involved.

This is not the type of inquiry that can be handled on e-mail. I would suggest that you take your case to an attorney who specializes in working on cases for disabled clients. If the facts are as you suggest, you may have a vaild and valuable claim. You may want to contact the State Bar Referral service 1-800-252-9690
