Legal Question in Civil Litigation in Texas
defamation by attorney in petition
Can an attorney be sued for defamation of character and libel for information which can be proven false and was known to be false before the petition was filed or is an attorney allowed to put anything in a petition because it is considered ''privledged''

Re: defamation by attorney in petition
Generally no suit could be filed against a lawyer for pleadings..but if false and the lawyer knew it was false, the opposing lawyer could ask the Court to sanction the lawyer..However, why not seek a claim agains the party who gave false info to the lawyer???
