Legal Question in Civil Litigation in Texas

Default judgement while out of the country.

I was out of the country for 3 months. While I was gone a default judgement was filed against me on a loan that I never had. I have documentation to prove I never received this loan. How do I file an appeal to this judgement?

Re: Default judgement while out of the country.

At this point you may have to file a procedure called a Bill of Review to set aside the judgment, unless you're still within the plenary period of the court (10 days for JP court, 30 days for all others). That's a fairly complex procedure and one you'd want a lawyer to handle.
