Legal Question in Civil Litigation in Texas

Denied Summary Judgements

I am the plaintiff and was stalked and sued Defendant for it and other things. The Defendant countered that it was frivolous, and filed a MSJ, and it was denied. If a Summary or Partial Summary Judgement is denied to the defendant, who takes the next step and how many days do they have to file something? Do they mount a defense to try to prove it was frivolous, or do I make the next move and file for a MSJ?

Re: Denied Summary Judgements

You are the plaintiff (complaining party). It's up to you to move your case forward.

As to how, I suggest you pay a visit to your county's law library and read up on trial procedure.

Without reading through the documents file it makes difficult to provide. Regardless, you should take the next move. Speak with your attorney regarding strategy and the next step.
