Legal Question in Civil Litigation in Texas

Deposing a CEO

Does Plaintiff in a civil case, which is valuable to his/her defense, possess the legal rights to depose a CEO? If defendant objects by stating '' irrelevant'' what legal ruling/citation from the court can plaintiff use in his/her defense to depose a CEO.

Respectfully,

Re: Deposing a CEO

I cannot answer this question without writing a virtual treatise on the subject. However, by applying a little common sense, you should get a feel for what is the proper answer. For example, I can tell you that you are not apt to get to depose a CEO of General Motors on local contract dispute with GM. Otherwise, he would spend his whole year giving depositions and would never finish all of the depositions.

However, if the CEO involved is the head of a small company and is personally involved in working on the transaction about which you complain, you most likely will get to depose him.
