Dog was Rehomed, Agreement between Parties

I re-homed my puppy October 20, 2008. I was in desperate need of finding her a suitable home because my living situation was going to change and did not allow for me to have a dog. I gave her to a lady I found through an interview process. Upon release of the dog, the other party advised I could have her back once my situation changed. She expressed to me that she understood what I was going through and how hard this was going to be. So, I agreed with her and said that if my living situation changed within the near future I would let her know. I have been trying to contact her for some time now so I may regain 'custody' of my puppy. She is not returning my phone calls or e-mails. I am not sure what to do. I even offered her a 'replacement' puppy so she is not empty handed. I feel a puppy would be adequate because it would be able to develop a new relationship with her and her with it. So, what can I do? Am I able to sue her based on a verbal agreement? There were witnesses, but on both sides... the result seems it would be my word against hers. I am willing to spend any amount necessary. Not only was this a hard choice, but I have regretted it so much that I am working more hours to live in a place I can have a dog.

there is no guarantee of success in litigation..go see the lady face to face..not by phone/email..but then you will know if you have any chance...try to get her written consent/do not take the dog without her written consent or you may be charged with theft...Sad situation..
