Legal Question in Civil Litigation in Texas

Filing a motion to schedule a trial

I am involved in a dispute with the Texas Work Force. I received benefits in 2001 and 2002 after being layed off. I then picked up a job teaching part time. For some reason there were questions concerning an overpayment. THey will not re hear my case. The only recourse I had was to file a petition for judicial review to the court to hear the case.

I just received a notice that a trial must be scheduled or the case will be dismissed. THe letter was from the court and I don't know how to file a motion for the court to schedule a trial. The overpayment they are claiming is $1300. I can prove that I don't owe this but trying to get an attorney would be more than this cost. Should I just let this go or try to fight it. I feel like I am really lost in a huge beauracracy.

Re: Filing a motion to schedule a trial

You should be able to find a motion setting trial in a form book at the law library. Follow those instructions carefully. You might have to attend a hearing on the motion to set trial.
