Legal Question in Civil Litigation in Texas

Fraud?

My husband & I had separated last May. He left to work out of town right after that. In the meantime, we were communicating and seeing each other on weekends. We were working on reconsiling. I went & had another line added to his cell phone account. Since Aug. 2006 I have received the bill & paid it monthly. We divorced in Nov. but kept the phones as they were. He would bring his money to me & I would pay the bill. I have now told him I no longer want the phone as I want to be completely free of him. He had the phone disconnected today and is now trying to tell the phone company I committed fraud by adding on the extra line. We were married at the time so wasn't I well within my rights? Is there anything he can do if I refuse to pay any part of the bill? Can they charge me with fraud or any other charge?

Re: Fraud?

What you did was within your rights, and there is no fraud.

If you fail to pay your portion of the bill, your ex can sue you for the money he has to pay out. If the cell phone company is looking to you to pay the bill, they can sue your for the unpaid amount.
