Legal Question in Civil Litigation in Texas

Friend Watched Stuff While I was Deployed Came Back to Nothing

I lent this person my car and asked her to watch all my belongings while I was in Iraq for four months. She was to clear out my apartment and turn in the keys and be out by 31 Oct. and set storage up in her grandfather's house, of which I told him I'd pay for the storage. He refused payment and assured me that everything was taken care of. I returned (left Oct 22, 2003) March 5, 2004 to NOTHING. My computer, my car, plates dishes bed sheets curtains, collectors items, family heirlooms, gone. The female said that my car was towed because it was parked in a no parking zone and that it was auctioned and sold already. I was not informed of this at all. She then told me that my computer was stolen out of the garage and that everything else was taken by her brother (eg military stuff). I then found out that all my stuff was at this guy Jaime's house and that my car was picked up by a company that it's assumed name had expired in 1990. My bank wasn't even notified of the auction/sale of the vehicle. I have a list of the things that were stolen and I'm sending her and this Jaime guy Certified letters telling them they have 10 days or the money or I'm gong to press charges on them. Is this the right thing to do?

Don't waste time with the letters. Proceed with pressing criminal charges.

Sounds like a serious violation of the Soldiers & Sailors Civil Relief Act. I recommend that you get a lawyer involved - have you tried contacting a JAG lawyer? If that is not an option, you need to contact a lawyer who is familiar with that act. As a soldier who was deployed, you have numerous protections under the law.
