Legal Question in Civil Litigation in Texas
This happened in Aug. 2011
A guy went to pick up a whirlpool tub for me and I have gotten the paper he signed saying that he picked it up. He called to tell me that he was having truck problems and had to call a tow truck. He asked me to come bring my truck to see if it would fit into my truck, but it wouldn't. He told me that he would drop it off at my house when he came through town. He later called to tell me that my tub flew out of his truck and he and the tow truck driver couldn't pick it up to put it back into the truck, so they left it on the side of the road and went to get another truck to come back and get it. Well, needless to say when they came back, it was gone. I have sent texts to ask about him paying for the tub, and he said he would pay for the tub. This tub was over $1,000.00. He has paid $250.00 so far, but he is now ignoring my texts, so I sent a certified letter a couple of weeks ago and he hasn't responded to that as of yet. I'm sure I will get a refusal/undeliverable note back anytime now. I wanted to know what I can do about this to get it resolved or have I waited to long listening to his lies about paying me back??

No, you haven't waited too long.
Sue him in small claims court; the filing fee will be about $100.00.
