Legal Question in Civil Litigation in Texas

Harrassment by neighbor.

My neighbor keeps calling the police complaining of noise. The police have never reported any excessive noise or taken any action. Our local noise ordinance specifies that noise complaints are not valid until midnight due to the fact that there is a race track near my home. The complaints have all been called in before midnight and the police continue to respond. None of my other neighbors say that they have ever heard any noise coming from my home. I am tired of the embarrassment and inconvenience of having the police visit my home all the time. What action can I take against my neighbor or the police to make this stop?

Contact a trial lawyer in your town. Have him write the neighbor and explain that you may file a harrassment suit if he keeps it up.

Be sure of your facts. Be sure you can document the number of prior complaints to the police from their logs.

The police are required to respond to citizen complaints. Don't bother them.
