Hit and run accident

I was hit by a teenage driver, who left the scene of the accident. She was followed by another driver and was stopped. I was able to talk to her and her father who said he would call his insurance to pay for the damage to my car. I have left several messages, and have had no response. Can I report this to the police as a hit and run? Or should I seek legal help?

It does not sound like there were any personal injuries. If there were...the most important thing is to get those taken care of.

I am assuming that when the other driver was followed and stopped, that it was not by the police.

If no police report was ever filed, you should get all the information together: yours, the other driver's, and all witnesses and file a police report as soon as possible. Many times you can call the police and they can dispatch an office to where you are and take the report information.

You may want to contact your insurance company and let them know you were in a hit and run and give them the details also. You want to protect yourself should they attempt to file a claim against your insurance. I am also assuming that he (the father) never gave you his insurance company's name. If he did you should make a claim against his insurance company.

Now, after reporting it to the police, you can send him a letter by certified mail, return receipt requested. Explain that you have tried to contact him (x) times to no avail and that he needs to contact you or you will have to retain legal counsel to resolve this matter.

In the meantime, you should discuss this with an attorney to make sure there are no deadlines that need to be met, should you decide to hire an attorney.
