Legal Question in Civil Litigation in Texas

illegal towing

On Nov. 3rd my car was parked in a reserved carport (of my apt complex)which I pay for every month. It has a tag clearly displayed on the rear view mirror. Another resident had it towed in belief that I was in thier spot. No one made any effort to contact me or the apt office to clarefy rights to the spot. We have a courtisy officer who tried to assist the resident by moving his vehicle to allow the resident to have a place to park until the matter could be resolved in the morning when the Apt office would be open. The resident then chose to have my vehicle towed anyways. The property owners also have a contract with a specific tow company and signs posted with contact info to this company should towing be neccessary. The resident chose to call a different company which made locating my car even more difficult. My wife and I both missed a full day of work trying to sort this out as well as paying $220.39 to have my car released. My car was damaged in the tow as well. Do I have a case?

Based on what you have written, you may have a civil action against the individual who had your vehicle towed from the apartment complex. You may want to consider a small claims action against the individual.
