Job abandonment

An employee left for lunch, never came back and despite attempts has not returned my call. Before he left he told a co-worker he quit. My manual says ''at termination of employment the employee will recieve any benefits accrued but unused upon termination''. Do I need to pay this guy his accrued vacation?

You said you would. Does that make any difference? but other than your promise in the manual, there is no law that says you have to pay accrued, unused benefits. Usually, the statements made in an employee manual are not contractual only aspirational allowing employers to get out of any promises made in the manual.
