Legal Question in Civil Litigation in Texas

judgment collections TX

I have a judgment against a person with a checking account at USAA HQ'd in TX. The money judgment was ordered in L.A. County, CA. Must I have the order domesticated in TX or can I send the Writ of Execution directly to USAA?

Re: judgment collections TX

Unfortunately, USAA Federal Savings Bank has only one branch -- it is located at 10750 McDermott Freeway, San Antonio, TX 78288.

You can proceed in one of two ways: 1) Have the judgment "exemplified" and then go to Texas (or retain a Texas attorney) to have a sister-state judgment entered, and then have the local sheriff levy on the judgment debtor's USAA bank account (I'm not licensed to practice law in Texas, and I don't know the exact procedure, cost, or duration); or 2) use another collection method as outlined in "Collect Your Judgment" (Nolo Press) or "Enforcing Judgments and Debts" (Rutter Group), both are in the law library at your local courthouse.

Having a judgment "exemplified" means having three different seals ("triple-seal") affixed to a copy of the judgment, this process takes a few weeks and there is a fee involved, look on the lasuperiorcourt.org website or call the clerk's office for more info.
