Why is it necessary to file a second legal document (lawsuit) to enforce an original legal document?

Without the lawsuit, no one buy you and the offender knows the original legal document needs enforced. You make the claim and the offender makes his/her defenses, if any. We've been doing it like this in one fashion or another since King Solomon.
