Lease deposit

I gave half of a lease deposit on a house which was not complete. The agreement was that the house would be complete by the end of september and I would lease the house only if it would be completed by that time and if not they would refund my deposit. The house was not complete on time and I had to lease another place but they don't return my deposit. What can I do?

Can you prove these terms with documents or witnesses? Is it your word against theirs? You can file a lawsuit in small claims court to recover your lease deposit.
