Legal Question in Civil Litigation in Texas

Are my legal rights being violated?

I am being sued in small claims court by an ex-boyfriend. When I discovered he had been in prision for 19 years for several charges one including rape.

he became my ex- boyfriend. Upon the breakup he became very violent. His violence, harassment and stalking went on for 8 months. We involved the police and his parole officer and a detective.

He was notified several times to make no attempts to contact me, family or friends, my mail and or other wise. he still prosisted via mail.

Then he filed a claim to suit me in small claims court. I can not make out exactly what he claims I owe him, but I can see it says 2100dollars..

I responded to the citation and included all the police information, as well as letters he had written me pertaining to any little thing he might have paid for. one year later, I received a court date for Jan. 23.

I am scared to death of this man. He terrorized us for over 8 months, to the point where we could not go outside. Now the court is saying he is allowed to do it some more.

If there was some grounds for him to base his claim on, then I could see the courts position, but there is not.

What rights do I have in this case?? Please Help.

Re: Are my legal rights being violated?

The court cannot prejudge the case just because you say it is groundless, but there are legal devices such as Summary Judgment which will allow you to attack his actions without a full trial.

Why not consult a lawyer in your town who can do this for you and you never have to go to court or face this individual?

Good luck.
