Legal Question in Civil Litigation in Texas

Mechanic's lien on vehicle

I had my vehicle inspected (a $12000 vehicle) and paid with a check. Unfortunatley the check bounced but I was unaware of that. A month and a half later the inspection place 'picked up' my car claiming they have the right to do that. Nothing filed in court, no lien on the vehicle with the county tax assessor, no notice to me. There was no repairs done nor was there a receipt or a contract signed. Never was I told that if the check bounced he could 'repo' it. He now wants an exorbiant amount of money from me. I've offered on several occasions to pay him what I owe him for the inspection and a possible returned check fee. What can I do to get my vehicle back?

Thanks

Re: Mechanic's lien on vehicle

The only way you'll get your vehicle back is by paying his fees, the bounced check charge, the repo fees, and storage fees. Then, if you feel the charges are unreasonable, you can sue him in Small Claims for the overcharges.

Be forwarned, though, the law is on his side.
