Legal Question in Civil Litigation in Texas

Minor Consumption

My son who is 17 was at a party where kids showed up with alcohol. He text messaged me that he was leaving because of this (I still have the text saved) but when he got to his car the police pulled up and made him go back inside.

They cited him for minor consumption and indicated that he admitted to drinking on the citation(this was put on all the kids citations...at least 20 kids). He said that he told the officer he had not but she said to ''tell that to the judge''. He had not had ANY alcohol. He does have to appear in court. Do we need an attorney and can we fight this charge since he was attempting to leave?
