Legal Question in Civil Litigation in Texas

Missing trustee

The trustee for your small comunity has passed and the legel frim that is handling her estate will not accept, phone or written correspondence. We need to inforce the deed restrictions. how can we appoint a replacement trustee ( Grantor )?

A long long time ago one could post such actions on the court house bulliten board and after a time it became a fact, I don't guess it can still be done.

Re: Missing trustee

No one can give an intelligent answer to your question without having an opportunity to read the relevant documents. As to posting on the courthouse door, you may be referring to probate matters, but I do not know of any such provision regarding actions to enforce a restrive covenant.

There are statutes regarding enforcement of restrictive covenants which allow for recovery of attorneys' fees and statutory damages in the event of a breach. I recommend that you contact an attorney before too much time has lapsed.

Re: Missing trustee

Read the restrictive covenants. That should tell you how to replace the missing party.
