Legal Question in Civil Litigation in Texas

Neighbor's dog hits Car

Upon driving home through the neighborhood at dark a neighbor's dog chasing a rabbit hit my moving auto broadside in the door. I am told the dog is OK, but my door has paint damage and a larger dent. This dog was supposed to be fenced in according to the neighbor but gets out alot. This is a public road in Smith County and not part of a city. Do I have recourse for my damage if my neighbor refuses to pay for the repair?

Yes you can sue in small claims court or make an insurance claim and have your ins. company try to collect from them. Their loose dog caused your damages, and they are responsible for the dog, especially when they know it gets out often.
