Legal Question in Civil Litigation in Texas

Option to receive subpoena

I am being asked by my former employers lawyer to testify in court to behavior I witnessed by a former employee, who is suing them for unpaid commission and emotional distress. I was told by their lawyer that I have the option to be subpoenaed and to let him know if I wanted to receive it or not. This lawyer told me that I am considered a lynchpin witness to this case. I am ambivalent about testifying. Is there any legal reason why he is giving me this option to receive the subpoena, and what are the pros and cons to my agreeing or not to be served? I appreciate your help.

Re: Option to receive subpoena

Essentially, it just means you can show up voluntarily or that you can be forced to participate by being sent a subpoena. Either way, you will end up testifying.
